These Terms of Service ("Terms") form a legal agreement between you and London Emergency Restorations ("we", "us", "our") governing your use of this website and the restoration, remediation and reconstruction services we provide. By using this website, submitting a form, or engaging us for services, you accept these Terms. If you do not agree, please do not use this website or our services.

1. Definitions

In these Terms: "Services" means any restoration, remediation, testing, removal, reconstruction or renovation work performed by London Emergency Restorations; "Service Agreement" means the separate written estimate, work order or contract confirming the scope, price and timeline for a specific project; "you" or "customer" means the person or business requesting or receiving Services; "property" means the residential or commercial premises where Services are performed.

2. Our Services

London Emergency Restorations provides water damage restoration, fire and smoke damage restoration, mould remediation, storm and weather damage repair, asbestos testing and removal, renovation and rebuild services, and insurance claim negotiating assistance to residential and commercial properties in London, St. Thomas, Lucan, Ingersoll, Strathroy, St. Marys, Aylmer, Muncey and Woodstock and surrounding areas. The exact scope of work, materials, timeline and price for any project are set out in a separate Service Agreement provided to you before work begins, and that Service Agreement governs in the event of any conflict with this website.

3. Eligibility

You must be at least 18 years old and have the legal authority to request Services for the property in question (as owner, tenant with authorization, or authorized property manager) to use this website or engage London Emergency Restorations for Services.

4. Quotes & Estimates

Quotes provided through this website, by phone, or in person are preliminary estimates based on the information available at the time and are not binding offers. Final pricing may change once our team has inspected the property in person and identified the full scope of damage or work required. A quote does not create a Service Agreement; work begins only once a Service Agreement is confirmed by both parties.

5. Service Agreements

Where the total price of a project exceeds the threshold set out in Ontario's Consumer Protection Act, 2002, or where the agreement is entered into remotely (including by phone, email or through this website) and is not fully performed at the time it is made, that agreement may qualify as a "future performance agreement" or "internet agreement" under the Act. In those cases, Ontario law requires the written agreement to include specific disclosures (including an itemized description of the goods and services, the total price, and delivery or start and completion dates) and, in most cases, gives you the right to cancel within 10 days of receiving a copy of the agreement if it does not meet those requirements. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2002 or other applicable consumer protection legislation, and those rights cannot be waived.

6. Cancellation Rights

Outside of the statutory cancellation rights described in Section 5, cancellation terms for a specific project (including any cancellation fee for work already scheduled, ordered materials, or completed labour) will be set out in your Service Agreement. Emergency mitigation work (such as water extraction or property stabilization) that has already been performed cannot be undone and is billable regardless of a later cancellation of remaining work.

7. Payment Terms

Payment terms, including any deposit, progress payments, and accepted payment methods, are set out in your Service Agreement. Amounts not paid by their due date may be subject to interest and collection costs as permitted by law and as disclosed in your Service Agreement.

8. Use of This Website

You agree to use this website only for lawful purposes. You may not use this site to submit false or misleading information, attempt to disrupt or interfere with the site's operation or security, scrape or harvest data from the site, or copy or reuse content from this site for commercial purposes without our written permission. Content on this website, including service descriptions, is provided for general informational purposes only. While we try to keep it accurate and current, we do not guarantee its accuracy and are not obligated to update it, and it does not form part of any Service Agreement unless expressly stated.

9. Website Security

We take reasonable steps to help keep this website secure, but no website can guarantee complete protection from viruses, errors or interruptions, and no method of transmitting data over the internet is completely secure. 10. Insurance Claims Assistance

Where a property damage insurance claim is involved, London Emergency Restorations may, at your request and with your authorization, communicate with your insurance adjuster, document damage, and help prepare a scope of work to support your claim. London Emergency Restorations is not an insurance provider, insurance broker or public adjuster, does not guarantee any claim outcome, and does not make coverage, approval or payment decisions — those decisions are made solely by your insurance company. Any advice we provide about a claim is general in nature and is not a substitute for the advice of your insurer, broker, or independent public adjuster.

11. Our Insurance Coverage

London Emergency Restorations maintains commercial general liability insurance and workplace insurance coverage applicable to the work it performs, consistent with standard industry practice for restoration contractors operating in Ontario. Proof of current coverage is available on request.

12. Warranties

Any warranty on workmanship or materials for a specific project will be set out in your Service Agreement. Except as expressly stated in a Service Agreement or as required by the Consumer Protection Act, 2002 or other applicable law, Services and this website are provided without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

13. Limitation of Liability

To the extent permitted by law, London Emergency Restorations' total liability arising out of or relating to the Services or this website is limited to the amount you paid for the Services giving rise to the claim, and London Emergency Restorations is not liable for indirect, incidental, special or consequential damages, including loss of income or loss of use, arising from the Services or from delays outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Ontario law, including liability for death, personal injury, or gross negligence.

14. Indemnification

You agree to indemnify and hold London Emergency Restorations harmless from claims, damages or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of this website, or information you provide to us that is false or misleading.

15. Intellectual Property

The content, design and graphics of this website belong to London Emergency Restorations or its licensors and are protected by copyright law. You may not copy, reproduce or reuse this content for commercial purposes without our written permission.

16. Trademarks

"London Emergency Restorations" and our logo are trademarks or trade names of London Emergency Restorations. You may not use our name, logo or branding without our prior written consent.

17. Third-Party Links

This website may reference or link to third-party services. We are not responsible for the content, accuracy or practices of any third-party site, and linking to it does not imply our endorsement.

18. Accessibility

19. Force Majeure

London Emergency Restorations is not liable for delays or failures to perform caused by events beyond our reasonable control, including severe weather, supply shortages, labour disruptions, or acts of government.

20. Governing Law & Disputes

These Terms, and any Service Agreement unless it states otherwise, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Before starting a legal proceeding, both parties agree to first attempt to resolve any dispute informally by contacting the other party directly. Nothing in this section prevents either party from seeking relief available under the Consumer Protection Act, 2002, including access to Ontario's courts as provided by that Act.

21. General Provisions

Severability: If any part of these Terms is found unenforceable, the remaining parts continue in full force. Entire Agreement: Together with your Service Agreement (if any), these Terms make up the entire agreement between you and London Emergency Restorations regarding your use of this website, superseding any prior discussions about that subject. Assignment: You may not assign your rights under these Terms without our consent; London Emergency Restorations may assign these Terms in connection with a business transfer. Notices: We may provide notices to you by email, phone, or by posting on this website.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or in applicable law, and may do so without individual notice to you. Changes will be posted on this page with a revised edited date, and your continued use of this website after a change is posted constitutes your acceptance of the revised Terms. Changes do not apply retroactively to a Service Agreement already in place.
